1.2 Bally provides a carrier collection service for all returns. Only return shipments using our approved courier will be free of charge and at Bally's cost.
1.3 Should you decide to use a courier other than the Bally approved courier, you will bear all direct costs. In such case, any costs or expenses incurred by you in the return of Products are not refundable. In this case, should your parcel be lost by the carrier you chose, Bally will not be responsible for it nor for releasing any refund.
1.4 You shall return the Products without any excessive delay and in any event within 14 (fourteen) days from the date of your notice of withdrawal.
1.5 You shall return the Products by packaging the relevant it/them securely. You shall return the Product(s) in the same condition in which you received them and they shall be returned in their original packaging; moreover, the Products shall not have been washed or damaged and the relevant identification tag shall still be attached to the Products with the disposable seal. Please note that Bally will review the returned Products via quality control. If the products will be sent back in perfect conditions, new and with all tags and labels attached, Bally will approve the return and reimburse the price originally paid. If the recipient of the Product(s) indicated in the order form is different from the individual who made the payment for such Product(s), the amount paid for returned items shall be refunded to the individual who made the payment.
1.6 If any of the labelling or tags are missing, do not comply with these T&Cs or Bally has any reason to believe that the Products have been altered or are imitation of the Products or were not purchased directly through this Website, Bally will not accept the return and will return the Products back to you.
1.7 Should Bally accept the return, we shall refund the price of the Product(s). Bally offers a resoling service for men’s Scribe shoes. Please contact Client Services in order to evaluate condition, assess service feasibility and obtain further information, including a quote for this service. Bally has two types of belt constructions – adjustable and fixed. If your belt is fixed, it has been designed with multiple size options to choose from. If your belt is adjustable, it has been designed with a singular length of material. The buckle can be removed and the material can be cut in order to fit you perfectly. Bally offers a belt cutting service in-store. For more information, please contact Client Services.
Delivery times are between three and six working days. We offer complimentary shipping and in-store collection on all orders.
Please note that delivery times are calculated from when we ship your order, not from the time it was placed. Once your order has been shipped, you will receive confirmation via email and in your Bally account.

7.1 Data collected will be stored and processed via an electronic system located in Bally and elsewhere in the world.
We retain your personal data for 7 years from the subscription date for the purposes specified in the paragraph 6. However, in some circumstances, we may retain personal data for longer periods of time, for instance where we are required to do so in accordance with legal, tax and accounting requirements. After this period, your data will be permanently erased or otherwise rendered anonymous in an irreversible way.
7.2 We protect user's Data using technical and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centres, and information access authorization controls.
8.1 Data will be accessible within Bally by the internal and external personnel.

1.1 This contractual warranty (the "Warranty Policy") is granted to you by Bally France SAS, with registered office in France at 35, Boulevard des Capucines, 75002 Paris, business register number 552 006 702 R.C.S. Paris , VAT number FR34552006702 (referred to as "Bally" or "we" or "us"), when you purchase Products from the Website www.bally.fr
1.2 Bally warrants to the consumer that the Products comply with the specifications and are free of material defects and workmanship errors for a period of twenty four (24) months from the date of delivery.
1.3 This Warranty Policy applies only to Products which are a) manufactured by or for Bally as identified by the "Bally" trademarks, trade name, or logo legally affixed to them and b) purchased by consumers from this Website.
1.4 If a Product has manufacturing defects or in any case of alleged lack of conformity of Products, in order to benefit from his/her rights under this warranty policy the customer must notify the Client Services on 00800 1851 1851, Email: serviceclientsFR@bally.ch within a period of two months from the date on which he/she detected such lack of conformity. In any case, the proceedings intended to enforce the lack of conformity not fraudulently hidden by Bally shall in any event expiry after twenty-six months from delivery of the Product(s).
1.5 To benefit from this Warranty Policy, the Product(s) should be returned to Bally within 15 (fifteen) working days following notification to Bally of the damaged or defective Products.
1.6 Bally will examine all Products returned as damaged or defective and in case of a lack of conformity, will replace the Product, or, if this is not possible, refund the price paid.
1.7 Bally will refund the price and your costs of returning defective Products using the same method originally used by you to pay for the purchase. If the recipient of the Products indicated in the order form is different from the individual who made the payment for such Products, the amount paid for returned items shall be refunded by Bally to the individual who made the payment.
1.8 In the event that Bally finds no fault with the returned Products, you will be notified that the returned Products cannot be accepted and you may elect to have the Products re-delivered to you. If you do not accept re-delivery, Bally reserves the right to retain the Products and the purchase price.
1.9 This Warranty Policy does not apply (i) if the Product has been subject to faulty and improper use, repair, alteration and/or modification in any way that is not covered in the documentation for the Product; (ii) to damages caused by failure to follow the instructions covered in the documentation for the Products or other specific instructions from Bally; (iii) if the Product is damaged by misuse, abuse, negligence, accident, normal wear and tear and deterioration, improper environmental conditions or lack of responsible care, (iv) to damages due to any other cause not related to defective design, workmanship and/or materials.
1.10 This contractual warranty does not affect your statutory rights under consumer law as a purchaser of goods and in particular the rights by virtue of which the seller from which the consumer bought the product remains bound by the contract in regard to any lack of conformity of the product and any hidden defect, as provided for in articles L.211-4 to L211-13 of the French consumer code and articles 1641 to 1648 and 2232 of the French civil code.
In this respect, you have the following rights vis-à-vis Bally:
Article L.211-4 of the French consumer code
The seller is required to deliver a product which conforms to the contract and is held liable for any lack of conformity which exists upon delivery.
He is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if he assumed responsibility thereof or had it carried out under his responsibility.
Article L.211-5 of the French consumer code
To conform to the contract, the product must:
1. be suitable for the purpose usually associated with such a product and, if applicable:
- correspond to the description given by the seller and have the features that the seller presented to the purchaser in the form of a sample or model;
- have the features that a purchaser might reasonably expect it to have considering the public statements made by the seller, the producer or his representative, including advertising and labelling;
2. Or have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.
Article L.211-12 of the French consumer code
Action resulting from lack of conformity lapses two years after delivery of the product.
Article L.211-16 of the French consumer code
When the purchaser asks the seller, during the term of the commercial warranty which was granted to him during the purchase or the repair of a good, a restoration covered by the warranty, any immobilization period of at least seven days is added to the remaining term of the warranty. This period runs from the request for action of the purchaser or the provision for repair of the good in question, if this provision is subsequent to the request for action.
Art. 1641 of the French civil code
A seller is bound to a warranty on account of the hidden defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the purchaser would not have acquired it, or would only have given a lesser price for it, had he known of them.
Art. 1648.§1 of the French civil code
The action resulting from redhibitory defects must be brought by the purchaser within a period of two years following the discovery of the defect.
